1. 30-Day Redemption Period

New Brunswick has a 30-day redemption period after the auction.

  • The original owner can reclaim the property within 30 days
  • They must pay all taxes owed plus costs
  • Your purchase is not final until this period expires
  • You will not receive title or keys during this period

2. Registration Requirements

The auction is open to registered bidders only. Registration is conducted onsite.

  • Government issued photo identification required
  • Proof of address required
  • Additional documents may be requested by auction organizers
  • Register early to avoid delays

3. Bidding Process

Understanding the auction rules is critical.

  • The highest bidder acknowledged by the auctioneer will be the purchaser
  • Auctioneer has sole discretion in case of disputes
  • All bids are irrevocable - you are legally obligated to complete the purchase
  • No cameras or recording devices permitted during auction

4. Payment Requirements

Full payment is required immediately following the sale.

  • Payment by cash or cheque at local Service New Brunswick Office
  • You must pay H.S.T. (where applicable)
  • All document preparation fees and transfer taxes are your responsibility
  • Failure to pay may result in disqualification from future auctions

5. "As Is, Where Is" Sale

Properties are sold with absolutely no warranties or guarantees.

  • Province makes no representations about property value or condition
  • No warranty regarding environmental contamination
  • No guarantee of vacant possession or access
  • Property may not be suitable for your intended use

6. Due Diligence is Your Responsibility

You must conduct all necessary research before bidding.

  • Order a title search from Real Property Online
  • Check for liens, mortgages, and encumbrances
  • Research zoning and land use restrictions
  • Inspect property from public street only (no trespassing)
  • Consult with legal counsel before bidding

7. Foreign Ownership Restrictions

Important for non-Canadian bidders:

  • Canada's Prohibition on the Purchase of Residential Property by Non-Canadians Act applies
  • Restrictions on purchases by non-Canadians and non-qualified Canadian organizations
  • It is YOUR responsibility to ensure you are legally eligible to purchase

8. Reserve Prices & Cancellations

The Province reserves significant rights.

  • Province can accept or reject any and all bids
  • Properties can be added or removed at any time without notice
  • Auction can be discontinued at any time without notice
  • No guarantees that any property will actually be sold

9. Legal Jurisdiction

This auction is conducted under New Brunswick law.

  • All sales governed by the Real Property Tax Act
  • Conducted in accordance with laws of the Province of New Brunswick
  • By participating, you acknowledge you have read and understood all terms
