Tax Sale Compass is operated by Cloudy Days Retail Inc. of Cold Lake, Alberta. Compass lists the sale and does not run it. The municipality does.
Alberta tax recovery sales are public auctions. The Municipal Government Act requires each municipality to offer at a public auction any parcel on its tax arrears list if the arrears are not paid (section 418(1)), and a parcel is sold when the auctioneer declares it sold (section 423(2)). A parcel that does not sell at the auction may later be sold by the municipality under section 425, and that later sale can use another method. Council sets the conditions of sale (section 419), and that is where deposit and payment terms are found. Process varies. Verify with the municipality before you bid.
Council must set a reserve bid for each parcel that is as close as reasonably possible to the market value of the parcel (section 419). A buyer at the auction takes the land free of all encumbrances except those listed in section 423(1), which include claims of the Crown in right of Canada, registered easements and certain caveats and liens. Once the auctioneer declares a parcel sold, there is no right to pay the arrears (section 423(3)).
131 past tax sales on record, 640 currently open for bidding.
